An employee with the right skills, a few thousand dollars in credits and a free weekend can suddenly create a forecasting tool, automate a revenue workflow or build an internal system that once would have required an entire development team. That sounds like innovation. It can also create an impressive collection of legal, compliance, data and intellectual-property problems before Monday morning. On the Go-To-Market Podcast, host Dr. Amy Cook sat down with attorney and legal advisor Adam Wardel to discuss the risks hiding behind the rush to build with AI. His message isn’t to stop experimenting. It’s to understand what you’re building, what data you’re putting into it, who actually owns the pieces underneath it and who will be responsible when something goes wrong. Here are some interview highlights: How did you develop your approach to AI, data and compliance? Artificial intelligence is something that you can’t just turn a blind eye to. You need to be an expert in it immediately. My career taught me that you should embrace new technologies and learn how to use them for competitive advantage. It also taught me to raise my hand and say yes, even when I didn’t immediately know the answer. Rather than operating as a legal cost center in the background, I wanted to become part of the advisory solution. With AI, that meant doing the research, understanding the technology and learning how to use it properly. I joke that I need a T-shirt that says: “The answer is yes, but now I’ll tell you how we’re going to get there.” Let’s say someone builds an AI-powered revenue system over the weekend. What could possibly go wrong? The first thing you have to consider is where you plan to implement it. AI requirements can vary between jurisdictions, from cities and counties all the way to major regulatory regimes such as the European Union. Then you need to start peeling back the layers. The first question is intellectual property. Your system may contain models, data, open-source code, third-party APIs, prompts, embeddings or training data that aren’t yours. You have built something that you are going to utilize in a public market that, frankly, doesn’t belong to you in totality. That can become dangerous when the system grows into something valuable. The next issue is data. People hear vendors promise not to use their data for training and assume the problem is solved. It isn’t. You still have to understand whether the data contains private or secure information and what obligations are attached to using it. There are also issues such as prompt injection, sensitive health information, discrimination, employment decisions and other areas of exposure. The bottom line is that there is far more involved than most people realize. You learned the founder-dependency lesson firsthand, didn’t you? I did. Three years before we sold my company, somebody came to me and offered me a ridiculously low number. That forced me to look at the business differently. I realized the problem was the guy in the mirror. I had made myself too important to the business. That experience changed how I thought about building the company and eventually selling it. AI agents can operate autonomously, but they aren't legally responsible people. So who is responsible when something goes wrong? That’s the issue people need to think about. Right now, the law does not consider an artificial intelligence a person that can be held responsible for its actions. There still has to be a human who is responsible. That’s why I sometimes compare these emerging intelligences to children. We teach children morals and ethics. We guide them while they learn. And as parents, we remain responsible for much of what they do. AI requires a similar level of thoughtfulness and oversight. The technology is amazing. I use it quite a bit. But we have to slow down enough to make sure the way we’re using it doesn’t create unnecessary exposure. Are there uses of AI that you consider relatively safe? Content is a good example. A safer way to use AI today is when it functions as an extension of your own brain rather than bringing significant amounts of external data into the equation. You can give it your ideas and let it organize them while remaining in control of the process. Let it do 50% or 75% of the thinking for you, but at the same time, you’re going to have to be the one that initiates and the one that reviews at the end. From there, you can move toward increasingly sophisticated organizational uses. The important part is thinking through the implications before deployment. The answer can still be yes.
